The Fertility Law Group has learned of a serious laboratory malfunction at Boston IVF’s Waltham, Massachusetts, center. According to statements made by Boston IVF, an incubator failure caused pH levels to spike, killing embryos stored in that unit. The incubator failure occurred between May 31 and June 4th, 2025.
The incubator failure destroyed numerous embryos. The exact number of patients affected is still being investigated.
Patients were not immediately informed of the disaster until days after the incident, by which time some had already started medications for their anticipated transfer.
Boston IVF has offered some patients a “free cycle” because of the error, but this falls far short of the emotional and financial impact of losing an entire cohort of embryos.
The Fertility Law Group is actively investigating how many families were harmed, what exactly caused the death of patient embryos, and whether Boston IVF’s quality-control practices meet industry standards.
“The destruction of embryos is a devastating, deeply personal loss,” said Rob Marcereau, Managing Partner of the Fertility Law Group. “We are determined to get answers for every family affected and to hold Boston IVF fully accountable.”
