Fertility Law Group has opened an investigation into potential IVF treatment failures, embryo losses, and unauthorized embryo handling involving Dr. Brian David Acacio, M.D., and fertility clinics operating as Acacio Fertility Center in Laguna Niguel and Bakersfield, California, following disciplinary action by the Medical Board of California.
According to public records issued by the Medical Board of California, Dr. Acacio’s medical license was placed under an Interim Order Imposing Restrictions effective October 8, 2025, which required, among other conditions, complete abstinence from controlled substances and compliance with biological fluid testing upon request of the Board.
On December 30, 2025, the Medical Board issued a Cease Practice Order after determining that Dr. Acacio violated those restrictions by testing positive for prohibited substances. The Order prohibited Dr. Acacio from engaging in the practice of medicine unless and until he completes at least thirty consecutive days of negative biological fluid testing and receives written authorization from the Board to resume practice.
During the period covered by the Board’s restrictions and subsequent suspension, Fertility Law Group has received reports from patients describing IVF treatment delays, medication and scheduling errors, unexpected clinic operational disruptions, billing disputes, and difficulties related to embryo storage, transfer, and release. Some patients have reported that embryos were relocated or retained under circumstances that were not fully explained or consented to, and that additional fees were demanded before embryos would be released so treatment could continue elsewhere.
